Between: Jardín Cosentido Rural and Cultural Accommodation, NIT 32240706-7, hereinafter referred to as THE ESTABLISHMENT, and one or more persons specified in the Accommodation Registration Card (TRA), duly identified, hereinafter referred to as THE GUEST, we have agreed to enter into this accommodation agreement upon the signing of the TRA, in accordance with the clauses and applicable Colombian legislation.

CLAUSES:

  1. OBJECT: Through this agreement, THE ESTABLISHMENT grants THE GUEST, under a commercial accommodation arrangement, the use and enjoyment of the room(s) specified in the TRA, as well as the common areas of the rural accommodation mentioned in the TRA, which are furnished and comply with the requirements of the hospitality sector in Colombia.

  2. DURATION: The term of this agreement is determined in the TRA, according to the reservation made by THE GUEST, and shall end on the date and time THE GUEST completes check-out, in accordance with the dates registered in the TRA. This agreement may be extended by express agreement between the parties. In case of extension, THE GUEST shall be subject to availability and the policies of THE ESTABLISHMENT.

  3. RATE: THE GUEST agrees to pay THE ESTABLISHMENT the total amount corresponding to the number of days of stay reserved and registered in the TRA. Payment shall be made in cash, bank transfer, or other agreed method, and must be completed in advance or at the time of TRA registration. By making the reservation and payment of the deposit, THE GUEST accepts the Cancellation and Refund Policy published by THE ESTABLISHMENT at _________________________.

  4. RESPONSIBILITIES OF THE GUEST:
    a. To keep the facilities in good condition.
    b. To use the furniture and equipment of the accommodation carefully and responsibly.
    c. To respect quiet and coexistence hours from 10:00 PM to 7:30 AM.
    d. To comply with internal house rules, the sustainability policy, and the tourism code of conduct of the municipality of Jardín, Antioquia.

  5. PROHIBITIONS:
    a. Entry of non-registered persons into the rooms is not allowed, nor occasional visitors of THE GUEST within the accommodation.
    b. Smoking is prohibited inside rooms, hallways, dining area, kitchen, or any unauthorized areas.
    c. Illegal activities of any kind are strictly prohibited, as well as any actions violating Colombian law and the municipality’s sustainable tourism policy.
    d. Parties and excessive noise are not allowed.

  6. ACCOMMODATION OF MINORS: In compliance with Law 679 of 2001, accommodation of minors without the presence and documentation of a parent or legal guardian is prohibited.

  7. SAFEKEEPING OF MONEY AND VALUABLES: THE GUEST has the right to entrust THE ESTABLISHMENT, upon arrival and with the proper completion of a Valuables Custody Record, with money or valuable items for safekeeping. THE ESTABLISHMENT hereby informs THE GUEST that it is not liable for belongings, money, or personal items that have not been deposited for safekeeping upon arrival and registration.

  8. LIABILITY DISCLAIMER: THE ESTABLISHMENT is not responsible for loss of valuables or money not reported through the Valuables Custody Record at check-in and TRA registration. THE GUEST accepts and exempts THE ESTABLISHMENT from any contractual or non-contractual liability arising from improper use or abuse of the facilities, furniture, and equipment (chairs, tables, beds, furniture, etc.), including rooms, bathrooms, common areas, green areas, crops, and water sources. Accordingly, THE GUEST waives any judicial or extrajudicial claims for damages or compensation arising from such situations.

  9. DATA PROCESSING AUTHORIZATION: For the safety of guests, staff, visitors, and facilities, THE GUEST may access the Privacy and Personal Data Protection Policy and Video Surveillance Policy established by THE ESTABLISHMENT, in accordance with Colombian Law 1581 of 2012, published on the website ____________________. By entering, staying, or circulating within the premises, and by signing this agreement and the TRA, THE GUEST freely, voluntarily, and expressly authorizes THE ESTABLISHMENT to process their personal data and those of their companions, including minors under their responsibility.

  10. DIGITAL SIGNATURE AUTHORIZATION: THE GUEST accepts that the scanning of their identification document and those of accompanying persons and/or legal dependents constitutes their digital signature and acceptance of the Accommodation Registration Card (TRA) and this Accommodation Agreement. THE GUEST expressly waives any legal action to invalidate the TRA or this agreement, including data processing authorization, in accordance with Law 527 of 1999 and Decree 2364 of 2012.

  11. EARLY TERMINATION: This agreement may be terminated without refund:
    a. When the guest commits serious violations of the accommodation policies, rules, or applicable Colombian hospitality laws.
    b. Due to force majeure or unforeseen events that prevent THE ESTABLISHMENT from fulfilling the agreement.

  12. COMMITMENT AGAINST SEXUAL EXPLOITATION OF CHILDREN AND ADOLESCENTS (ESCNNA): THE ESTABLISHMENT is committed to protecting children and adolescents and rejects all forms of sexual exploitation, commercial exploitation, pornography, and violence against minors, in accordance with Laws 1336 of 2001 and 679 of 2001 and related regulations. THE GUEST acknowledges this commitment and agrees to refrain from any form of child sexual exploitation. THE ESTABLISHMENT warns that such acts are subject to criminal and administrative sanctions in Colombia and will be reported to the competent authorities.

  13. LEGAL CLAUSE: THE GUEST acknowledges that this contractual relationship is governed by Law 300 of 1996, its amendments, regulations, and relevant provisions of the Commercial Code and Civil Code, excluding Colombian residential lease laws.

Child Protection Policy

Jardín Cosentido Rural Accommodation is committed to the protection of minors and establishes the following policy in accordance with Law 679 of 2001, Law 1098 of 2006 (Childhood and Adolescence Code), and Law 1336 of 2009, related to the comprehensive protection of children and adolescents in Colombia.

To stay with minors, the following conditions must be met:

  1. Communication: The guest must inform, at the time of booking or prior to arrival, that they will be accompanied by a minor.

  2. Authorization: Minors are only allowed to stay if they are accompanied by at least one parent or by a legally authorized adult with properly notarized consent.

Upon check-in, the following will be required:

  • Identification document of the minor

  • Identification document of the accompanying adult

  • If the accompanying adult is not the parent, a notarized authorization signed by the parents or legal guardian, along with copies of the parents’ identification documents

  1. Supervision: All minors must remain under the direct supervision of the responsible adult throughout their stay.

  2. Restrictions: We reserve the right of admission if this policy is not complied with or if there is any suspicion of rights violation.

Any indication or suspicion of exploitation, abuse, or violation of minors’ rights will be reported to the competent authorities, in accordance with Law 679 of 2001 and Law 1336 of 2009.

Pet-Friendly Accommodation Policy

In compliance with Law 746 of July 19, 2002, the National Police Code (Articles 124 and 126), and Law 1346 of 2009, Article 30, pets are welcome under the following conditions:

  1. Permission and prior communication

The guest must inform at the time of booking or before arrival that they will be traveling with a pet.

Only small or medium-sized pets are allowed.

  1. Guest responsibilities

The pet must always remain under the direct supervision and care of the guest and may not be left alone inside the room.

The guest is responsible for:

  • Collecting and properly disposing of pet waste throughout the entire stay.

  • Preventing noise, aggressive behavior, or any actions that may disturb the peace, safety, or comfort of other guests and the environment.

  • Using a muzzle and leash for breeds classified as special management or whenever required by local regulations, in compliance with Article 124 of the National Police Code.

  • Providing all necessary items for the pet’s feeding, safety, and rest.

The guest will be fully responsible and assume all costs for any damage caused by their pet to other guests, staff, facilities, or equipment of the accommodation.

  1. Accommodation fee

The guest must pay an additional fee for pet accommodation, which will be communicated at the time of booking.

  1. Restrictions and safety

The accommodation reserves the right to restrict or deny entry to pets if their presence is considered a risk to the safety, health, or well-being of other guests or the natural environment.

Pets are not allowed in designated common areas (which will be clearly signposted and communicated).

Under no circumstances are pets allowed to be bathed in the room shower or to use room linens or bedding. Pets are not allowed on beds or furniture.

  • We make use of natural lighting. Turn off lights and electrical and electronic devices when leaving the rooms!

  • We use water responsibly. We reuse rainwater and washing machine water. Take short showers, avoid single-use plastic by carrying a reusable bottle. Every drop counts!

  • We optimize printed materials.

  • We protect the rural landscape from noise and visual pollution. Less advertising in the mountains, more nature!

  • Use only what is necessary!

  1. Waste management and separation:

  • We use containers for the proper disposal of solid waste: recycling, general waste, and composting.

  • We carry out composting for use in crops and gardens.

  • We reduce resource consumption to what is necessary.

  • We reuse waste: restore, repair, and transform. Creating is our constant!

  1. Circular, solidarity-based, and local economy:

  • We use products from farmers, creators, entrepreneurs, and businesses from the region.

  • We promote responsible tourism activities in coordination with formalized tourism service providers.

  • We promote the appreciation and practice of artistic and cultural expressions, tranquility, cleanliness of the environment, and the avoidance of excessive noise or activities that threaten biodiversity and local culture.

  1. Management and prevention of social risks:

  • We protect children and adolescents from sexual and commercial exploitation, pornography, and violence, in accordance with Law 1336 of 2009 on sexual abuse offenses, Law 679 of 2001, and Law 1236 of 2008 on the fight against sexual exploitation of children and adolescents (ESCNNA).

  • We protect vulnerable populations from discrimination and exclusion, in accordance with Law 1482 of 2011, Convention No. 169 on Indigenous and Tribal Peoples, Constitutional Court Order 004/2009 on the protection of the fundamental rights of displaced Indigenous peoples due to armed conflict, and Judgment T-025/04.

The commitments of Jardín Cosentido Rural and Cultural Accommodation are oriented toward continuous improvement.

Cancellation and Refund Policy

This policy is governed by the Colombian Consumer Statute, Law 1480 of 2011, which establishes the right of withdrawal for distance purchases.

  1. Standard rate:

  • The guest must pay 50% of the total price in advance at the time of booking.

  • The guest may cancel the reservation free of charge up to 3 days before the arrival date.

  • The guest may cancel the reservation up to 2 days before the arrival date and use 100% of the deposit or amount paid to reschedule the reservation, valid for a maximum period of 12 months (no further refunds will be made).

  • The guest will pay 50% of the total reservation value if the cancellation occurs within 2 days prior to the arrival date (no refund of the deposit will apply).

  • No refund of the deposit will be issued if the guest cancels on the same day of the reservation or does not show up.

  • Refunds of the deposit will be processed within 8 business days following the cancellation request.

  1. Non-refundable promotional rate:

  • The guest must pay 100% of the total price in advance at the time of booking; this amount is non-refundable.

Video Surveillance Policy

With the aim of ensuring the safety of our guests, staff, visitors, and facilities, Jardín Cosentido Rural and Cultural Accommodation informs that it operates a video surveillance system in accordance with current legal regulations.

Areas under video surveillance:

  • Main entrance of the accommodation

  • Outdoor common areas

Purpose of the video surveillance system:

Recordings are used exclusively for security purposes and the protection of people and facilities, and may be made available to competent authorities, as established in Article 237 of the National Police and Coexistence Code (Law 1801 of 2016).

Limitations:

  • There are no cameras in private rooms or bathrooms, in compliance with the right to privacy and personal life.

  • Recordings are not used for commercial purposes or unauthorized monitoring.

Storage and access to information:

  • Recorded images are securely stored for a maximum period of 30 calendar days, unless a legal or authority request requires longer retention.

  • Access to recordings is restricted exclusively to authorized personnel and will only be shared with judicial or administrative authorities upon legal request or order.

Legal basis:

This policy is established in accordance with the following regulations:

  • Political Constitution of Colombia – Article 15: Right to privacy and habeas data

  • Law 1581 of 2012 – General Personal Data Protection Regime

  • Article 237 of the National Police and Coexistence Code (Law 1801 of 2016) – Use of technological means for security
